ROMS - Old Console Game Titles Adapted To Play on a PC - Lawful Or Piracy

We all know ROMs. They are old popular console games that are downloaded to play on a PC program called an emulator.

What they are

In gaming speak, ROMS are old console games originally stored in read-only cartridges distributed by game vendors such as Nintendo, Sega, Sony etc, before the advent of modern storage media such as cd, dvds etc. Roms can also be found as image files in obsolete format.

Originally these game titles were only to be played on the console they were designed for: gameboys', Segas' etc. Of course, your normal computer cannot read the original ROMS without a special adapter. That is basically the role of emulators: specially written programs to imitate (emulate) the functioning of the original console.

This allowed nostalgic gamers to play onto their PCs' the old titles, without the help of the console, sometimes out of market.

Copyright issue

As ROMS were only to be played on the vendor's hardware, a copyright issue arises as to whether it is violating the vendor's right when a gamer downloads these onto their pc, either because the original console is no longer on sale or simply out of personal preference?

What the law says

The game vendors EULA (end user license agreement) falls within the provision of copyright law, 17 USC 106:

"Subject to sections 107 through 120 , the owner of copyright under this title has the exclusive rights to do and to authorize any of the following ..."

2) to prepare derivative works based upon the copyrighted work etc."

This is the position of console vendors such as Sony or Nintendo, who totally prohibit the copying and storing of "derivative works", including ROMs.

Changing the format from the original cartridge to a pc format therefore violates the vendor's rights to prepare derivative works under 17 USC 106.2.

But, but, but, this right is not absolute: the act says " Subject to sections 107 through 120 ...". The vendor's right to his product is limited. That is in fact why Nintendo and Sony have to come up with a EULA that completely prohibit the copying and storing of their titles onto another format than the original.

Obviously some forms of "derivative work" are not only acceptable under the act, but in some cases, essential for the intended use of the program in question. We mention here a Microsoft windows installation Cd that has to be installed onto your pc (basically copied).

Coming back to ROMS...

Which takes us back to the question: how can nostalgic gamers find legitimate ways to copy and store old unplayable games onto their pc?

There are many theories:

1. the backup theory

2. public fair use

3. development purposes

4. Operational adaptation etc.

But these are old defenses that hardly stand scrutiny given that most ROMs these days are downloaded off the internet and do not exactly fall into the ambit of defenses 1, 3 and 4.

Remains defense 2, public fair use.

In the supreme court case, Sony Vs Betamax, it was argued that personal use, no commercial use constituted a legitimate defense to reproduce copyrighted material. To quote from the judgment, " Any individual may reproduce a copyrighted work for a "fair use;" the copyright owner does not possess the exclusive right to such a use."

This basically means that as long as your ROMS are copied and stored for personal use meaning with no commercial intention. Of course the onus would be on the gamer to prove that their use is strictly personal and limited to public fair use.

Nintendo Wii "Fishing Master" Review

Ever since I was a little girl I have loved to go sit out by a pond and fish. It never really matter to me if I caught anything or not, it was just fun trying. I've tried different video games to replicate the real act of fishing and found them rather boring and quite unrealistic. However, the Nintendo Wii has a version of "Fishing Master" that really caught my attention. As video games go, this is as close one can get to fishing without having to deal with worms, hooks, and tangled line.

There are really two types of formats when playing fishing video games;

1) an arcade type of game that can be fun, but lacks reality and

2) realistic fishing modes that can make you feel as though you are actually catching fish.

The Nintendo Wii has combined the two to make this video game experience something fun for whatever type of mode you wish to play in. The characters themselves are cartoon in creation; however the act of using a fishing rod makes the video game more realistic for the player.

There is only one mode of play in this video game however there is a setting for multiplayer's in the Battle mode. In the single player campaign mode the player advances through the stages by catching different types of fish. The video game offers tournaments and challenges throughout the game play and players earn points which they use to buy items such as bait and other specialty items.

Players stand facing the water and as the player moves from end of the beach to the other, they will be able to catch different fish from those points. The fundamental aspects of the video game are very easy to learn right from the start.

The Nintendo Wii's version of "Fishing Masters" is what I believe the most entertaining and realistic approach to video game fishing; it is fun, challenging and creative. It is as close as you might get to the real thing without having to fight bugs, baiting hooks, and smelling like you've rolled in dead fish. The only problem there is that I can see is that you'll have to buy fresh fish from the market if you want to have your catch as dinner.

Wii Fit - The Aerobic Exercise Alternative

I usually hate video games. I just have no interest in them at all! But Wii Fit isn't really a video game like any other. It's really like having your own personal trainer in a way except I've had my own personal trainer in real life and I actually prefer the Wii Fit version because it's more fun!

Wii Fit really does make exercise fun (has hard as that is to imagine.) It turns it into a game. You'll end up doing the "rhythm boxing" or the "hula hoop" (two examples of the aerobic "games") for hours just because you want to beat your friend's score (yes it keeps track of everyone's scores.)

It includes aerobics, yoga, strength training, and balance games. I mostly do the aerobics and yoga myself. The balance games are really fun too actually but I don't think they give as good of a workout as the aerobics part.

One of the really cool things about the Wii Fit is that it keeps track of everything you do and how much you weight. This is really excellent if you are trying to lose weight. It keeps you from going "off course" if you are weighing in every day.

But the main reason I think it's so great is just flat out that it's fun. Making exercise fun definitely makes it a lot easier to find the motivation to exercise. Heck, sometimes I'm having so much fun with this that I don't even want to stop. I "play" it for hours sometimes. Compare that to riding a stationary bike or running on a treadmill. I've never wanted to keep on doing that. It's no comparison really. I plan on cancelling my gym membership and just using the Wii Fit instead. In the long run it'll actually save me money too.

Guitar Hero Wii

I think I've hit one of the must-have games for any Wii owner that enjoys rock music. You get a physical "guitar" controller with this game, and it's amazingly fun!

It is one of the most enjoyable games for the Wii. You can download Guitar Hero III, from several sites. If you are going to download the game, make sure you get the guitar controller to play it, otherwise you will be playing thin air for sure. You hold the controller just like a real guitar, and it's switchable for left handed players. The neck of the guitar has 5 buttons on it that you play with your left hand. In the center of the guitar is a "strum" button that you hit to play the notes. There's even a metal bar to wiggle, to cause the notes to "bend" to give an extra crowd boost.

The basic game play of Guitar Hero III involves a track of notes that scroll in time to a soundtrack; you finger fret buttons on the guitar controller to make the notes and score points.

There are four difficulty levels. You start with easy of course, where it's great fun to play along with your favorite songs and just have fun. When you crank up to the higher levels - moving through various venues and unlocking different characters and guitars - the keys get VERY difficult. Still, it's a blast hammering away at the notes that appear on screen, waving your guitar around in the air and having fun. You hit the matching buttons, and a rock star is made. In Guitar Hero III, you'll be making the rock with one of the best soundtracks to be found in any rhythm game. The soundtrack covers multiple eras and genres. Classic rock is represented with songs such as Santana's "Black Magic Woman," the Rolling Stones' "Paint it Black," and ZZ Top's " La Grange ." Alternative rock from the '90s is present in a big way with tracks such as The Smashing Pumpkins' "Cherub Rock," Red Hot Chili Peppers' "Suck My Kiss" and Pearl Jam's "Evenflow" on-hand. ROMS - Old Console Game Titles Adapted To Play on a PC - Lawful Or Piracy

We all know ROMs. They are old popular console games that are downloaded to play on a PC program called an emulator.

What they are

In gaming speak, ROMS are old console games originally stored in read-only cartridges distributed by game vendors such as Nintendo, Sega, Sony etc, before the advent of modern storage media such as cd, dvds etc. Roms can also be found as image files in obsolete format.

Originally these game titles were only to be played on the console they were designed for: gameboys', Segas' etc. Of course, your normal computer cannot read the original ROMS without a special adapter. That is basically the role of emulators: specially written programs to imitate (emulate) the functioning of the original console.

This allowed nostalgic gamers to play onto their PCs' the old titles, without the help of the console, sometimes out of market.

Copyright issue

As ROMS were only to be played on the vendor's hardware, a copyright issue arises as to whether it is violating the vendor's right when a gamer downloads these onto their pc, either because the original console is no longer on sale or simply out of personal preference?

What the law says

The game vendors EULA (end user license agreement) falls within the provision of copyright law, 17 USC 106:

"Subject to sections 107 through 120 , the owner of copyright under this title has the exclusive rights to do and to authorize any of the following ..."

2) to prepare derivative works based upon the copyrighted work etc."

This is the position of console vendors such as Sony or Nintendo, who totally prohibit the copying and storing of "derivative works", including ROMs.

Changing the format from the original cartridge to a pc format therefore violates the vendor's rights to prepare derivative works under 17 USC 106.2.

But, but, but, this right is not absolute: the act says " Subject to sections 107 through 120 ...". The vendor's right to his product is limited. That is in fact why Nintendo and Sony have to come up with a EULA that completely prohibit the copying and storing of their titles onto another format than the original.

Obviously some forms of "derivative work" are not only acceptable under the act, but in some cases, essential for the intended use of the program in question. We mention here a Microsoft windows installation Cd that has to be installed onto your pc (basically copied).

Coming back to ROMS...

Which takes us back to the question: how can nostalgic gamers find legitimate ways to copy and store old unplayable games onto their pc?

There are many theories:

1. the backup theory

2. public fair use

3. development purposes

4. Operational adaptation etc.

But these are old defenses that hardly stand scrutiny given that most ROMs these days are downloaded off the internet and do not exactly fall into the ambit of defenses 1, 3 and 4.

Remains defense 2, public fair use.

In the supreme court case, Sony Vs Betamax, it was argued that personal use, no commercial use constituted a legitimate defense to reproduce copyrighted material. To quote from the judgment, " Any individual may reproduce a copyrighted work for a "fair use;" the copyright owner does not possess the exclusive right to such a use."

This basically means that as long as your ROMS are copied and stored for personal use meaning with no commercial intention. Of course the onus would be on the gamer to prove that their use is strictly personal and limited to public fair use.

The Nintendo Wii console is a great tool for encouraging children and adults alike to get fit whilst at the same time have fun.

American McGee's Alice - A Maddening Wondergame

You know, for me it is sometimes impossible to fight back the urge to snatch an old CD from my shelf, relax and do some retro-gaming. It's just because that several years ago and earlier there were some gems of game industry released, that are crafted with talent and inspiration yet unmatched. I consider "American McGee's Alice" to be one of such undeniable masterpieces.

Everything about this game gets me enraptured. Firstly, it is a third-person shooter based upon the novels by Lewis Carroll: "Alice's Adventures In Wonderland" & "Behind The Looking-Glass". They have been creatively... altered to fit the gameplay process one usually expects from a TPS - lots of action, challenging tasks, brutality and absorbing atmosphere. Impressive? Sure it is. "Alice" will throw you into the world of madness only the mind of a dedicated mushroom-eater (or a game designer like American McGee) could have invented.

Continuing the plot of original novels, American McGee produced a story of little Alice Liddel, who lost her home and parents in a fire and went mad with grief. In the asylum she is re-visited by the White Rabbit and thus she plunders once more into once beautiful Wonderland - now a horrible, dangerous, agonizing realm.

Design and atmosphere are the strongest features of this game. While playing, you will never be rid of the feeling that this IS actually Wonderland... or Nightmareland. All the major and minor characters and locations were brought to life in a very inventive and exquisite way so you could enjoy. Cheshire Cat, White Rabbit, Mad Hatter, Tweedle-de-dee and Tweedle-de-dum, Queen Of Hearts and many other - they are all there, as your allies and foes.

Graphics of "Alice" is quite good, taking into account the year of release - far-far 2000. If millenium starts with a game like this one, it is surely going to be quite surreal. Texturing, animation and modelling are performed very well, the picture is quite pleasant to look at, so the prominent design received quite an attractive graphical realization thanks to Quake 3 engine. This oldie can still deliver good visual effects.

Gameplay is out-and-out simple, like any shooter has. Though entourage and atmosphere make it addictingly superb, and it is capable of making you drift away for several hours or even till morning. I wonder what excuse you would make up for your boss. :)

Sountrack is another powerful instrument that contributes to the overall morbidly enchanting atmosphere. Composed by Chris Vrenna, it is a masterpiece of psychedelic ambient that can fall into your brain quite well even separately from the game itself.

In the main, I recommend this game to anyone fond of Lewis Carroll's books (but not too fond :)), of surreal games and great third-person-shooters. The overall score is 10/10.

Sacrificing the summer vacation for a time in the farm is not exactly the kind of time out you'll be looking for if you're any normal teenager. But Anna in Farm Mania is not your average teen. Well, she's normal alright, but she loves farming, and this is your chance to take time out with her in this time management game from Realore Studios.

The story of Farm Mania starts after gramps from the farm asks Anna to spend her summer vacation with him. You see, he's already too old to tend to the crops and animals, making the whole farm too run-down and neglected. Good thing that Anna is much in love with agriculture, and thus, begins her goal of making the farm as thriving as possible before summer's end.

Just like the other farm-based time management games, your task in Farm Mania is to plant crops, tend to your livestock and sell all the produce off for profit. Your objectives for each day are summarized during the start of each level and are outlined for you on the bottom of the screen during the actual game. Keep in mind that you have to complete all the objectives before the timer runs out, because if you manage to beat the level within 75% of the time, you'll earn bonus money for all your efforts.

At first, you'll only have to deliver a certain number of crop types to the market through Johnny, the farm's delivery boy. But as the game progresses, the gameplay picks up as you go about raising chickens and goats to name a few, and even making flour and baking pastries too! Good thing that grandma takes care of all the baking and grandpa gathers the water and feed, so you just keep your mind focused in gathering produce and rearing animals and crops, making the gameplay pretty convenient even with its frantic nature.

Get Omnislash Disc 1 - Cloud's Final Limit of Final Fantasy 7

Omnislash in Disc 1 is easiest to earn right after the Temple of the Ancients. I would recommend using Cloud for the Battle Arena since he is overall the best character between stats, weapons, and limits. Make sure to equip the Nail Bat and Ribbon on him. Note that the Nail Bat does not possess any Materia slots.

Next equip Cloud with an Armor with the most Materia slots possible without losing Defense or Magic Defense. Cloud will now possess average-high Attacks, well rounded Defense/Magic Defense, and immunity to basically all status ailments (thanks to the Ribbon). Having his Level 3 Limits is highly advised as well since they are powerful. Next onto Materia configuring.

Recommended Materia
Nail Bat: No Materia slots
Armor: Restore, HP Plus, Enemy Skill (Beta, Big Guard, White Wind, Magic Hammer), Odin

Now travel to the Gold Saucer Wonder Square to stock up on Gold Saucer Points (GP). Play the Bike Mini Game 10-20 times earning 100-200 GP. Since each try at the Battle Arena is 10 GP. So in turn each game successfully completed of the Mini Bike is equivalent to one try at the Battle Arena. Food for thought.

That takes care of all the prep work. Now find the Battle Arena and start battling. Here are the most notable enemies that might cause you a pain in the back.

Appearance: Grim Reaper
Move: Joker (Instant Death)

Appearance: Jelly Blob
Move: Drain (MP)

Note: MP is crucial in the Battle Arena. It might even be more valuable than HP.

Appearance: Pirate Ship
Move: Exits you from the Battle. Annoying because you get 0 Battle Points (BP) for being thrown from the Battle in the Final Round. Defeat this enemy quickly.

Slot Battle Arena Point System In a Nut Shell
Final Round Handicaps determine how many points you will receive after defeating the last enemy. Basically the more difficult Handicaps give more BP. The No Handicap or Restore Bonuses give low BP. Try to get these Handicaps because they pay off the best.

Broken Weapons/Armor/Accessories/Materia (High BP)
Toad/Mini (Medium BP)

After earning Omnislash for between 60,000-70,000 Battle Arena Points the rest of the game will be simple. To put it simply by defeating Jenova at the end of Disc 1 with 16-hits from a devastating Nail Bat. To those of you attempting to unlock Omnislash Good Luck!
